1. Acceptance of Terms

By creating an advertiser account on PickAd.dev, you agree to these Terms of Service.

2. Eligibility

• You must be at least 18 years old or represent a legal business entity
• You must provide accurate business/contact information
• You agree to use the platform for legitimate advertising testing only

3. Service Description

PickAd provides crowdsourced creative testing where:

• You upload creative variants for comparison
• Real users vote on which variant they prefer
• You receive aggregated voting results
• Results are for guidance only – not guaranteed performance predictions

4. Campaign Submission

Content Guidelines – You agree NOT to upload creatives containing:

• Illegal content or activities
• Explicit sexual content or nudity
• Hate speech, violence, or discrimination
• Misleading or fraudulent claims
• Copyrighted material you don’t own
• Malware, viruses, or harmful code
• Content targeting minors inappropriately

Approval Process:

• All campaigns are reviewed before going live (typically within 24 hours)
• We reserve the right to reject any campaign without explanation
• Rejected campaigns will be refunded to your account balance

5. Pricing & Payments

Credits:

• You purchase credits to run campaigns
• Current rate: <$1 AUD per vote. Pricing subject to change without notice.
• Minimum purchase: 1 Credit
• Credits never expire

Billing:

• All payments processed securely via Stripe
• Credits are non-refundable once purchased except in some circumstances
• Unused credits for rejected campaigns are returned to your balance

GST:

• All prices are in AUD and exclude GST
• GST will be added to invoices where applicable

Campaign Costs:

• Credits are deducted as votes are received
• You can stop campaigns anytime to preserve credits
• Final costs depend on actual votes received

6. Refund Policy: 

All credit purchases are final and non-refundable
– Unused credits remain in your account indefinitely
– Credits can be used on future campaigns
– Refunds may be issued at our discretion for technical issues

7. Results & Data

What You Receive:

• Vote counts and percentages for each variant

Accuracy Disclaimer:

• Results reflect voter preferences only
• We do not guarantee votes represent your target market
• We do not guarantee correlation with actual ad performance
• Results are for informational purposes

Quality Assurance:

• We use anti-cheat systems to ensure vote quality
• Low-quality votes are filtered out
• We reserve the right to invalidate suspicious votes without refund

8. Intellectual Property

Your Content:

• You retain all rights to your uploaded creatives
• You grant us license to display them to voters for testing purposes only
• We will not use your creatives for any other purpose
• We will not share your creatives publicly or with competitors

Confidentiality:

• We treat your campaigns as confidential
• Voters see creatives anonymously without brand identification
• Results are private to your account only

9. Account Termination

We may suspend or terminate your account if:

• You violate these terms
• You upload prohibited content repeatedly
• You attempt to manipulate the system
• Your account shows fraudulent activity

Upon termination:

• Unused credits may be refunded at our discretion
• Active campaigns will be stopped
• Access to historical data may be revoked

10. Australian Consumer Law

Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy provided by the Australian Consumer Law (ACL) or any other applicable law that cannot be lawfully excluded.

Our services come with guarantees that cannot be excluded under the ACL. For major failures with the service, you are entitled to cancel your service contract and receive a refund or compensation.

To the extent permitted by law, our liability for breach of any consumer guarantee is limited to, at our option, re-supplying the services or paying the cost of having the services re-supplied.

11. Limitation of Liability

To the extent permitted by law:

• Our liability is limited to your account balance
• We are not liable for business losses, opportunity costs, or consequential damages
• We are not liable for decisions made based on voting results
• Maximum liability: Amount paid for the specific campaign in question

12. Indemnification

You agree to indemnify PickAd against claims arising from:

• Your uploaded content
• Copyright or trademark infringement
• Violations of advertising regulations
• Misleading or fraudulent creatives

13. Changes to Service

We reserve the right to:

• Change pricing with 30 days notice
• Modify features or functionality
• Discontinue the service with reasonable notice

14. Governing Law

These terms are governed by the laws of the State of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
